These terms are the agreement between you and INKYY Bojan Sandić s.p. Laktaši ("Upform", "we", "us"), which runs the Upform form builder at upform.com and app.upform.com.

What these terms cover and who can use Upform

These terms apply to the website, the app, the forms you build and publish, and the integrations you connect. By creating an account or using Upform, you agree to them. If you do not agree, do not use Upform.

Our Data Processing Agreement covers the data we process for you when people answer your forms, and it forms part of these terms. Our Privacy Policy explains how we handle personal data about you as an account holder.

You must be at least 16 and old enough to form a binding contract where you live. If you use Upform for a company or other organization, you confirm you are allowed to accept these terms for it, and "you" then includes that organization.

People who only fill out a published form do not need an account. The creator of a form is responsible for it and for how its answers are used.

How your account works and how to keep it secure

You can sign up with an email address and password, or with your Google account. You agree to:

  • give accurate details and keep your email address current, because password resets and important notices go there;
  • use a strong password that you keep private and do not use on other services;
  • not share one login between several people (on Pro, invite team members instead);
  • tell us at hello@upform.com right away if you think someone else has accessed your account.

You are responsible for activity in your account. We will never ask for your password by email.

What the Free and Pro plans include

Upform has two plans. Both include unlimited forms, unlimited responses, all 21 question types, conditional logic and every integration.

The Free plan is permanent, not a trial. It does not expire, it does not turn into a paid plan on its own, and we do not ask for card details to use it. "Unlimited" means we set no fixed cap. It does not cover use that puts the service or other customers at risk.

How Pro billing works

There is no online checkout. To move to Pro, email hello@upform.com from the address on your account. We will reply to confirm the price, how and when to pay, and any taxes that apply, then upgrade your account by hand.

Pro is a monthly plan that runs month to month until it is canceled, and $12 per month is a launch price. If we change the price, we will tell you by email before the new price applies to you, so you can cancel first. If a payment is not made when due, we may move your account back to the Free plan after letting you know.

Canceling Pro

You can cancel Pro at any time by emailing hello@upform.com. Pro stays active until the end of the month you have paid for, then your account moves to Free. Unused months are not refunded unless the law requires it, and nothing here removes a consumer's legal right to cancel.

Moving to Free does not delete your forms or responses. Upform branding returns on your published forms, and team members lose access to your workspace (their own accounts are not affected). If your stored files are over the Free limit of 100 MB, we will contact you before we remove any of them.

How team members work

On Pro, the account owner can invite up to 5 team members by email. An invitation stays pending until the person accepts or declines it. Team members work in the owner's workspace, within the permissions the owner gives them.

  • Each team member needs their own Upform account and must follow these terms.
  • Forms, responses and files created in the workspace are part of the owner's account, and the owner controls them.

The owner is responsible for what team members do in the workspace and for removing people who should no longer have access.

Who owns your forms, responses and files

Your content stays yours

"Your content" means everything you put into Upform or collect through it: forms, questions, designs, logos, images, logic rules, responses, uploaded files and the contacts built from responses. You own it. Nothing in these terms gives us ownership of any of it.

The license you give us

You give us a limited, worldwide, non-exclusive license to host, store, copy, process, transmit and display your content, only as needed to run Upform for you: showing your published forms, storing answers, producing your analytics and sending answers to the integrations you connect. The license ends when your content is deleted, except for copies the law requires us to keep and backup copies until they are overwritten.

We do not sell your content or use it for advertising. We look at individual forms or responses only when you ask for help, to keep the service secure, to investigate a breach of these terms, or when the law requires it.

Your respondents' data

For the personal data people give in your forms, you are the controller and Upform is your processor. We process it on your instructions, as set out in the Data Processing Agreement. As the controller, you are responsible for:

  • having a lawful basis for each piece of information you ask for;
  • giving respondents any notice the law requires, such as who you are, why you ask, which tools receive their answers and how long you keep them;
  • getting consent where the law requires it, for example before adding someone to a mailing list;
  • handling requests from respondents who want to see, correct or delete their data.

For your Results panel, Upform records views, starts, submissions, completion time, device type and country, using a random ID stored in each respondent's browser. Public submissions are checked by Google reCAPTCHA, under Google's Privacy Policy and Terms of Service.

Upform's own content

The Upform software, website, name, logo and templates belong to us. You may use Upform and its templates to build and run your own forms, including forms for clients. A form made from a template is your content, but the template stays ours. You may not copy or resell the service, and on the Free plan you may not hide or remove the Upform branding on published forms. We may use feedback you send us without owing you anything.

What you may not use Upform for

You are responsible for the forms you publish and how you use the answers. You must not use Upform to:

  • build phishing forms, or any form that collects passwords, login details, security codes or other account credentials;
  • collect payment card numbers or card security codes, government ID numbers (such as passport, national ID, driver's license or Social Security numbers) or images of identity documents;
  • collect protected health information where HIPAA requires a business associate agreement (we do not sign them);
  • create unlawful, deceptive or fraudulent forms, such as fake giveaways, fake job offers or scams;
  • impersonate another person, company or organization, or suggest a connection with them that does not exist;
  • send spam, or promote your forms through unsolicited bulk messages;
  • upload, distribute or link to malware;
  • collect personal data without a lawful basis, without the notice the law requires, or from children without any parental consent the law requires;
  • harass or exploit anyone, or infringe anyone's copyright, trademark, privacy or other rights;
  • overload, disrupt or attack the service, including sending automated or fake submissions or trying to get around reCAPTCHA or plan limits;
  • reverse engineer, decompile or copy the service, except where the law allows it;
  • access, or try to access, accounts, forms or data that are not yours.

We do not review forms before they are published and have no duty to monitor them. If we believe a form breaks these rules, we may unpublish it, remove content or suspend the account, and we may report illegal activity to the authorities.

To report a form built with Upform that looks like phishing or abuse, email hello@upform.com with its link. To report a security vulnerability, follow the steps on our security page.

How integrations and third-party services work

You connect each integration with your own account on that service, through its sign-in (OAuth), or through an endpoint you provide for custom webhooks and n8n. Today that means Google Sheets, Slack, HubSpot, Klaviyo, Mailchimp, monday.com, Notion, n8n and custom webhooks.

  • When a form is submitted, we store the answers and send them to the integrations you have connected.
  • You are responsible for having the right to send answers to the services you connect, and for telling respondents where their answers go when the law requires it.
  • Once data reaches another service, that service's own terms and privacy policy apply, and we are not responsible for how it stores or uses the data.
  • You are responsible for securing the webhook and n8n endpoints you provide. n8n requests carry an HMAC-SHA256 signature in an X-Upform-Signature header for you to check.
  • Google Analytics is a connection only. Upform sends it no data today.
  • Google Forms is a one-way import into Upform. We write nothing back to Google Forms.
  • You can disconnect an integration at any time. Data already sent stays in the other service.

If another service changes its API and an integration breaks, we will try to restore it but cannot promise to.

What we promise about availability

We work to keep Upform secure and available, but we do not offer a service level agreement or an uptime guarantee. The service may be interrupted for maintenance, provider problems or events outside our control.

We may add, change or remove features. If we remove a feature you rely on or reduce what your plan includes, we will tell you in advance when we reasonably can. Features described as planned are not part of the service until they are released. Keep your own copies of anything important.

When an account can be suspended or closed

You can stop using Upform at any time, and you can delete individual forms and responses yourself in the app. To close your account and have your content deleted, email hello@upform.com from the address on the account.

We may suspend or close your account, or unpublish specific forms, if:

  • you break these terms, especially the acceptable use rules;
  • we need to in order to protect respondents, other customers, the service or the public;
  • the law or a valid request from an authority requires it;
  • a Pro payment is overdue after we have told you (we normally move you to Free rather than close the account);
  • we stop offering Upform altogether.

Where we reasonably can, we will tell you first, explain why and give you a chance to fix the problem. For serious abuse such as phishing, malware or fraud, we may act immediately and without notice.

How to get your data out when an account closes

Before you close your account, download your responses as CSV files from the Responses panel and save any uploaded files you want to keep.

If we close your account for a reason other than serious abuse or a legal requirement, or stop offering Upform, we will give you reasonable notice and a chance to export your content first.

After an account is closed, we delete its content from the live service within a reasonable period, unless the law requires us to keep something. Residual copies may remain in backups for a limited time before they are overwritten.

What we do not guarantee

We provide Upform "as is" and "as available". To the extent the law allows, we give no warranties beyond those in these terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that Upform will be error-free or uninterrupted, that every submission or integration delivery will succeed, that reCAPTCHA will stop every automated submission, or that Upform meets a legal or regulatory requirement specific to your organization.

Upform holds no SOC 2, ISO 27001 or similar certification, so check it fits before you collect regulated data. Our templates and guides are not legal advice. If you are a consumer, nothing in these terms removes rights that consumer law gives you.

Limits on our liability

To the extent the law allows, we are not liable for indirect or consequential losses, or for loss of profits, revenue, business, goodwill or data. Our total liability for all claims relating to Upform or these terms is limited to the greater of the amount you paid us for Upform in the 12 months before the event that caused the claim, and 100 US dollars.

Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.

When you are responsible for claims against us

If someone brings a claim against us because of your forms, your content, the way you collected or used respondents' data, or your breach of these terms or the law, you will cover the reasonable costs, damages and legal fees that result. We will tell you about the claim promptly and let you take part in the defense. If you are a consumer, this section applies only as far as the law allows.

Which law applies and where disputes are heard

The law that governs these terms, and the courts that can hear disputes about them, are the laws of Bosnia and Herzegovina (Republika Srpska) and the competent courts at our registered seat in Laktaši. If you use Upform as a consumer, you also keep the protection of the mandatory consumer laws of the country where you live.

Before starting a formal dispute, please email hello@upform.com so we can try to resolve it. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may be able to bring a claim in your local courts.

How we change these terms

We may update these terms as Upform or the law changes. The date at the top shows the latest version. If a change materially affects your rights, we will tell you by email or in the app, with reasonable advance notice. Changes needed for legal or security reasons may take effect sooner.

If you keep using Upform after a change takes effect, the new terms apply. If you do not agree, stop using Upform and close your account, or cancel Pro before the change applies to you.

Other legal terms

  • These terms and the Data Processing Agreement are the whole agreement between you and us about Upform. If they conflict on personal data, the Data Processing Agreement wins. The Privacy Policy is a notice, not part of the contract.
  • If a court finds part of these terms unenforceable, the rest still applies. Not enforcing a term right away does not waive it.
  • Neither of us is responsible for delays or failures caused by events outside reasonable control.
  • You may not transfer your account or these terms without our written agreement. We may transfer them to a company that takes over Upform, and we will tell you if that happens.
  • Sections meant to last beyond an account closing, such as disclaimers, liability limits, indemnity and governing law, continue to apply.
  • We send notices to the email address on your account, and you can send notices to hello@upform.com.
